  • In 2014 there have been 10 trials – each trial has been a victory for the client:
  • Hall County State – Blood test .12 – Acquitted – no expert
  • Athens-Clarke County – Refusal -Acquitted
  • Habersham – DUI DRUGS – Acquitted
  • Cobb County – Vehicular Homicide (2nd degree) – Not Guilty VH-2
  • Union County – Vehicular Homicide (2nd degree) – Not Guilty VH-2
  • White County – DUI – Under 21 – Not Gulty
  • Lumpkin County – DUI – Refusal – Not Guilty
  • Forsyth County – DUI DRUGS – Reduced prior to Jury Selection
  • Union County – Serious Injury by Vehicle – Not Guilty
  • Hall County – Blood Test – Not Guilty on DUI Counts
  • Oakwood – DUI/Accident – Not Guilty All Counts (11/13/2014)

THE CRIMINAL DIVISION OF MCDONALD & CODY will have a minimum of 10 jury trials every year. Over 10 contested motions. Collectively, the firm has had over 100 jury trials civil and criminal. Sam has been either lead counsel in 10 trials this year or second chair.

The following cases represent a small fragment of our practice. We do not win every case nor do we tell prospective clients we win all of our trials. Simply put, if you are in court often you will lose trials. The following list will, however, give you an idea of the many jurisdictions we try cases in:
